New EU law gives Europe countries access to DVLA database

speed camerasA Europe Union directive which came into effect at the weekend gives European countries access to the database of UK’s Driver & Vehicle Licensing Agency. The new directive means that drivers with DVLA registered cars will face huge fines for offences such as speeding in EU countries.

Speeding drivers caught on camera could be hit with penalties of up to €750 (around £640 at current exchange rates) in France, Spain and other EU nations. The directive also applies to drivers who don’t wear seatbelts, don’t stop for red traffic lights or use their mobile phones while at the wheel.

Before the new ruling came into effect on Saturday, European police forces could fine British drivers for any offences committed if they were stopped at the roadside. Images captured on speed cameras could be used to prosecute drivers of hire cars as they had to supply their details when picking up vehicles.

The EU directive giving EU nations the rights to access vehicle databases of other countries was actually introduced in 2015, but the UK was given two years to comply. Laws in the UK and most European countries are not the same.

In the UK, the person driving the vehicle in which an offence is committed is liable for any penalties. In European nations, including France and Spain, the vehicle owner is considered the offender.

The EU directive in effect means Britons will have to pay for their transgressions in Europe, but the same will not apply to European drivers in Britain. Commenting on the new law, a Department for Transport spokesperson said that while still a part of the EU the UK had to comply, but this would be reviewed after Brexit in 2019.
