Thomas Cook awarded damages in bogus holiday illness claim by Brit couple

playadel inglesA British couple who tried to scam holiday giant Thomas Cook for £10,000 have been ordered to pay almost £4,000 themselves. The presiding judge at Liverpool Court ordered Michael McIntyre and Julie Lavelle to pay court costs for their attempt to claim compensation for a sham holiday sickness.

Lawyers for the couple lodged the holiday sickness claim against Thomas Cook three years after they had returned from a fortnight’s holiday in Gran Canaria. The court heard that in the intervening three years after the 2013 holiday, the couple had not contacted Thomas Cook regarding their alleged gastroenteritis.

The Letter of Claim stated that both the couple and their children had contracted gastroenteritis on their third day at the Parque Cristobal Hotel. The claim also stated that family had continued suffering from gastroenteritis for the remainder of their holiday and after their return to the UK.

The court was told Julie Lavelle had claimed her son and daughter both suffered from diarrhoea and vomiting while still at the Parque Cristobal yet had not contacted hotel staff or Thomas Cook’s representatives. The family’s flight back to the UK was incident free too even though the couple later claimed they were still suffering from food poisoning.

Michael McIntyre hammered another nail into the coffin of any future claim for sickness compensation by ticking the good and excellent boxes in a holiday survey questionnaire. He claimed he had done this as he was in high spirits as a result of drinking six pints of pre-flight beer.
